Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Flightline ("Company," "we," "us," or "our"), including our website at flightlinehq.com and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Flightline provides mortgage loan quality control review services. Our Services include document review, guideline compliance verification, and structured QC reporting for mortgage lenders. The specific scope of services will be defined in a separate service agreement or order form between you and Flightline.

3. Eligibility

The Services are intended for use by businesses and professionals in the mortgage lending industry. By using our Services, you represent that you are authorized to bind the entity on whose behalf you are accessing the Services.

4. User Accounts

To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services.
• Interfere with or disrupt the integrity or performance of the Services.
• Upload or transmit any malicious code, viruses, or other harmful content.
• Reverse engineer, decompile, or disassemble any aspect of the Services.

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are the exclusive property of Flightline or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Services without our express written permission.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information exchanged in connection with the Services. This includes, but is not limited to, loan files, review findings, business processes, and technical information. Confidentiality obligations survive the termination of these Terms.

8. Data Handling

We process loan files and related documents solely for the purpose of providing QC review services. Customer data is not used to train models, is not shared across organizations, and is handled in accordance with our Privacy Policy. Each client's data is logically isolated within our systems.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FLIGHTLINE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLIGHTLINE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Flightline and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of these Terms. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
